Onsiteable PTY LTD (“we”, “us”, “our” or “Onsiteable”) may collect personal information when you make an application to become an independent onsite service provider ("Onsiter”) with Onsiteable, use our Onsiters’ mobile application (“Onsiter App”) and interact with Onsiteable as a Onsiter. We are dedicated to protecting your privacy and set this document (“Privacy Policy”) to explain our approach in connection with the handling of Onsiters’ personal information.
This Privacy Policy applies to Onsiter applicants, registered Onsiters, or the substitutes (“you”, “your”) (Terms regarding personal information provided during the application and onboarding phase do not apply to substitutes). Please read this document with great attention. If you are a registered Onsiter and you use substitutes to provide services on your behalf, you are also responsible for making sure that your substitutes have read and understood this Privacy Policy before they start providing onsite services with Onsiteable. By accessing or using Onsiter App or otherwise sharing your personal information with us, you accept that your personal information is collected, shared, and otherwise handled in accordance with the terms of this Privacy Policy. If you do not consent to any of the terms of this policy, please do not use the Onsiter App or otherwise provide your personal information to us.
Information We Collect and How We Collect It

1)Account setup and application process

When you make an application to become a Onsiter at Onsiteable, we ask you to provide information such as your name, contact details, date of birth, postcode, preferred location to provide services, vehicle type, service equipment, emergency contacts, bank account information, right to work, and whether you have any unspent criminal convictions. In order to complete the application process, we (or a third party) may also ask you to share further information and documents including a copy of your government identification and proof of address so we can conduct criminal background checks and verify your right to work. Depending on the type of vehicle you use, we may require you to provide a copy of your license, your insurance information, and the vehicle registration details.

We may collect and store other information you provide about yourself during your communications or interactions with Onsiteable (e.g. when you speak with our supporting staff).

3)Automatic Information Collection

a.Onsite services: We record information about your onsite services including the orders you accept or reject, the date and time of onsite service acceptances, the date and time of order pick-ups, the date and time of order completions, the amount of time taken to complete the orders, payment details for each order and any feedbacks we receive about your onsite services.

b.Service period: We collect and store information about your onsite service period.

c.Location: When the Onsiter App is running either in the foreground or background of your device, we may collect the precise location of the device. When you request to use a location-based function in The Onsiter App, we access your location from your device in order to provide this functionality.

d.Device data: We collect technical information from your mobile device or computer, such as its operating system, the device and connection type and the IP address from which you are accessing The Onsiter App.
How and Why We Use Your Information
3.We will only process the data we collect about you if there is a reason for doing so, and if that reason is permitted under related Australian law and regulations. We will have a lawful basis for processing your information:
1)If we need to process your information for the performance of a contract with you or to enter into a contract;
2)We have your consent;
3)We have a justifiable reason, which is in our legitimate interests, for processing your data; or
4)We are under a legal obligation to do so.
4.Where we need to process your information for the performance of a contract with you, or at your request before we enter into a contract, we use your information:
1)to provide and manage your Onsiter registration, account, and service process, including executing any contracts with you;
2)to provide you with access to and use of the Onsiter App;
3)to communicate with you about your services with Onsiteable and any important changes or developments of the Onsiter App;
4)to enable supporting staff to communicate with you to support your services; an
5)to compensate you for your onsite services and offer you order
5.We may process your data with your consent (or, in certain circumstances, in our legitimate interests) to send you notice about Onsiteable’s products and services, and/or any promotions from third parties which are designed to support your provision of services to Onsiteable. You always have the option to unsubscribe from these emails.
6.We may also process your data when it is in our interests to do so. The following list covers some but not exclusive basis which we may relied on to process your data:
1)to improve the effectiveness and quality of service that the users can expect from us in the future;
2)to tailor opportunities that we share with you so you can make more money in connection with your onsite services;
3)to enable our supporting staff to help you with any enquiries, complaints or incidents in the most efficient way;
4)to contact you for your views and feedback on the Onsiter App and to notify you if there are any important changes or developments to the Onsiter App;
5)to provide Onsiteable services and a positive experience to our customers and other partners, such as by providing live order progress updates using your order progress swipes on the Onsiter App;
6)to analyse your activity on the Onsiter App so that we can administer, support, improve and develop our business and for statistical and analytical purposes and to help us to prevent fraud;
7)to enforce our contractual terms with you and any other agreement, and for the exercise or defence of legal claims and to protect the rights of Onsiteable, customers, or others (including to prevent fraud);
8)to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
Disclosure of Your Information
7.The information we collect from you will be transferred to and stored on our servers located within Australia. We are very careful and transparent about who else your information is shared with.
8.Sharing your information internally
We share your information with other Onsiteable group companies only where necessary for our legal interests and when it is permitted by law.
9.Sharing your information with third parties
1)To promote the safety and quality of the Onsiter App, we may share your information such as your name, contact number, vehicle type and location (before and during trip) with customers. To facilitate our ordinary business operations, we may also share your information with third parties who provide services to us, including third parties that provide payment and direct deposit processing, background and driving record checks, web analytics, data processing, IT services, customer support providers, data protection providers and other services. We may also disclose aggregate, anonymous information to these third-party service providers.
2)Onsiteable will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy when it is transferred to third parties.
10.Business transaction
If our business enters into a joint venture with, purchases or is sold to or merged with another business entity, your information may be disclosed or transferred to the target company, our new business partners or owners or their advisors.
11.Legal obligations and rights
We may also share your information:
1)if we are under a duty to disclose or share your information in order to comply with (and/or where we believe we are under a duty to comply with) any legal obligation or regulatory requirement. This includes exchanging information with other companies and other organisations for the purposes of fraud protection and prevention;
2)in order to enforce our contractual terms with you and any other agreement;
3)to protect the rights of Onsiteable, business partners, customers, or others, including to prevent fraud.
Retention of Your Personal Information
12.We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).
13.When determining the relevant retention periods, we will consider factors including:
1)our contractual obligations and rights in relation to the information involved;
2)legal obligation(s) under applicable law to retain data for a certain period of time;
3)statute of limitations under applicable law(s);
4)our legitimate interests where we have carried out balancing tests (see section on ‘How we use your personal information’ above);
5)actual or potential disputes; the establishment, exercise or defence of any (actual or potential) legal claim; and
6)guidelines issued by relevant data protection authorities.
14.When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
Your Privacy Rights
15.You can review and change your personal information by logging into the Onsiter App and visiting your account profile page.
16.You may also contact our Onsiter Support Team to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your onsiter account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
Controls for Do-Not-Track Features
17.Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
Changes to Our Privacy Policy
18.We may update the Privacy Policy from time to time. If we make any material changes to how we treat your personal information, we will post the new privacy policy on this page and notify you by email, text message or pop-ups notice whichever method that can achieve the purpose. It is your responsibility for ensuring us having your up to date and deliverable email address and active phone number.
